THIS IS AN AGREEMENT BETWEEN YOU AND NIKE in connection with your use of GAME GROWERS proprietary materials and services, including but not limited to the gamegrowers.com website, the Game Growers Training Camp, The Game Growers Showcase, the Game Growers Journey, and other program materials and resources (collectively "Game Growers"), to design and create a submission entry. Game Growers is sponsored by NIKE USA, Inc., One Bowerman Drive, Beaverton, Oregon 97005, with support of partners (collectively “Sponsor”).
BEFORE DOWNLOADING OR UPLOADING ANY CONTENT FROM OR TO THE GAME GROWERS WEBSITE, YOU SHOULD READ THIS AGREEMENT CAREFULLY. BY DOWNLOADING OR UPLOADING ANY CONTENT FROM OR TO THE GAME GROWERS WEBSITE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT.
YOU MAY BE PART OF GAME GROWERS IF YOU ARE IN THE 7TH OR 8TH GRADE AND ARE 13 YEARS OF AGE (BY THE DATE YOU SUMBIT YOUR APPLICATION). HOWEVER, YOU MUST BE AT LEAST 18 YEARS OLD TO ENTER INTO THIS AGREEMENT. IF YOU ARE UNDER 18 YEARS OLD, YOU MUST HAVE A PARENT OR LEGAL GUARDIAN CAREFULLY READ AND GRANT PERMISSION FOR YOU TO ENTER INTO THIS AGREEMENT.
By submitting an entry, each applicant and their parent/guardian acknowledge that they have read and hereby agree to the rules and regulations of Gamer Growers as listed here.
GAME GROWERS: This team-based, national competition provides an opportunity for 13-year-old girls to use their voice and creativity to help engage more girls in sport. Sport is defined as competition, movement, and play.
ELIGIBILITY: This program is open to legal permanent US residents who are thirteen (13) or older at the time of entry and are actively enrolled in the seventh (7th) or eighth (8th) grade. Employees of NIKE USA, Inc., its parent company, Nike, Inc., their subsidiaries and affiliates (collectively “NIKE”), or of other companies associated with the promotion of the Game Growers program, as well as the immediate family and household members of each such employee are not eligible. In addition, NIKE sponsored athletes and their immediate families are not eligible.
REQUIREMENTS FOR ENTRIES: Game Growers Co-Captains is defined as two 7th or 8th grade girls (age 13 or older when the application is submitted) (the “Submitter”).
WHEN CAN I ENTER? The contest starts on or about 12:01 AM PDT on 10/18/2021 and ends at 11:59 PM PDT on 11/15/2021 (the “Entry Period”). Late or incomplete submissions will not be accepted.
HOW DO I ENTER? During the Entry Period, applicants will visit www.GameGrowers.com and follow all application instructions to complete and submit an entry. There is a limit of one (1) entry per person. Subsequent entries will be void. All entries become the property of Sponsor and will not be acknowledged or returned.
SELECTION OF FINALISTS: Each Game Grower Co-Captain submission will be assigned to a local WNBA/NBA team. Assignments will be determined by the Sponsor and based off the postal code identified on Team’s application. Sponsor has the sole discretion to determine the assignment of the WNBA/NBA team. Submissions will be reviewed by Sponsor using a 100-point scale to identify the top five semi-finalists for each WNBA/NBA team. Each WNBA/NBA team will then review their top five semi-finalists and choose their respective finalists. Submissions will be evaluated based on the following criteria (as defined below):
Innovative approach to a solution (30 points)
Creativity relative to existing resources (20 points)
Feasibility of implementation (20 points)
Potential for impact (20 points)
Clarity (10 points)

SELECTION OF FINALISTS: All Co-Captain finalists will be chosen and notified by December 31, 2021.
Finalist Teams must be available for publicity and promotional purposes after acceptance into Game Growers - including media interviews with newspapers, radio and TV. Game Grower partners may provide the media with the winning team’s details, photographs and/or video footage for publication or broadcast.
INTELLECTUAL PROPERTY RIGHTS: All Submitters release ownership of all intellectual and industrial property rights (including moral rights) in their Submissions. NIKE, including GENYOUth, sponsors, agencies, and partners have full and unlimited rights to use and share submissions.
"Submission" means an entry consisting of the original concept material submitted for Game Growers by the Submitter. "Intellectual Property" means copyrights, design rights, patents, designs, registered designs, trademarks, service marks (or an application for any of these), inventions (whether patentable or not), invention disclosures, discoveries, improvements, processes, test and qualification processes, schematics, specifications, formulae, procedures, proprietary information, know-how, technology, trade secrets, technical data, works of authorship (whether copyrightable or not), mask works, software (in source code and object code forms), databases, data collections, and documentation and all copies and tangible embodiments of any of the foregoing throughout the world in whatever form or medium.
Representations and Warranties: Submitter represents and warrants that the Submission including all content and material used in the Submission is the original work of the Submitter.
Representations and Warranties Regarding Third Party Intellectual Property: The Submitter represents and warrants to Sponsor that Submitter has not submitted any Submission that infringes any third party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, patent, trade secret, rights of privacy or publicity, or confidentiality obligations of another.
Other Representations and Warranties: Submitter represents and warrants that:
The Submission does not violate applicable federal, state, or local laws; and
The Submission has not been entered in previous contests or won previous awards; and
The Submission has not been published or distributed previously in any media; and
The Submission does not contain any claims that are not and cannot be substantiated or that would be false and/or misleading.
RELEASE: To the maximum extent permitted by the law, the Submitter hereby releases, waives and forever discharges Sponsor and any of its respective affiliates, officers, employees, members or agents of and from any and all claims, obligations, debts, causes of action, and liabilities whatsoever.
CONSENT: Accepting the invitation to be Game Growers, participants grant permission to sponsors and their agencies to use winners' names and/or likenesses for advertising and/or trade purposes without further compensation unless prohibited by law.
The Submitter hereby consents to use of the Submitter's name, images, photo, city, state, likeness, Submission and prize information worldwide, in perpetuity, for all purposes (including advertising, marketing, promotion, in any media outlet including wireless/mobile devices and the exploitation of any and all ancillary and subsidiary rights) and the same may be edited, in all media now known or hereafter created, throughout the world, without limitation and without payment or consideration, except where otherwise required by law. The Submitter additionally consents to the release of all Personal Data collected by the Sponsor.
INDEMNITY: To the maximum extent permitted by law, the Submitter agrees to defend, indemnify and hold harmless Sponsor, its affiliates and its respective directors, officers, employees and agents from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys' fees) arising out of or accruing from (a) any act, default or omission on the part of the Submitter; (b) Submitter's breach of any warranty set forth herein; (c) any material uploaded or otherwise provided by the Submitter that infringes any copyright, trademark, trade secret, trade dress, patent or other intellectual property right of any person or defames any person or violates their rights of publicity or privacy, (d) any misrepresentation made by the Submitter in connection with Game Growers; (e) any non-compliance by the Submitter with the Rules applicable to Game Growers; and (f) claims brought by persons or entities other than the parties to this Agreement arising from or related to the Submitter's involvement with Game Growers or use or acceptance of any prize or prize-related activity including any responsibility for travel or accommodation associated with Game Growers.
LIMITATION OF LIABILITY: Sponsor accepts no liability for any claims arising in connection with Game Growers. In no event shall Sponsor be liable for any loss of data, lost profits, business interruption, or other special, incidental, consequential, punitive, indirect, or speculative damages under any legal theory (including negligence and strict liability).
CHANGES: Sponsor may, at its discretion, make changes to participation rules and this agreement, including but not limited to dates and deadlines, websites and resources, and recognition of submissions.
