THIS IS AN AGREEMENT BETWEEN YOU AND NIKE in connection with your use of GAME GROWERS proprietary materials and services, including but not limited to the gamegrowers.com website, the Game Growers Training Camp, The Game Growers Showcase, the Game Growers Journey, and other program materials and resources (collectively "Game Growers"), to design and create a submission entry. Game Growers is sponsored by NIKE USA, Inc., One Bowerman Drive, Beaverton, Oregon 97005, with support of partners (collectively “Sponsor”).
BEFORE DOWNLOADING OR UPLOADING ANY CONTENT FROM OR TO THE GAME GROWERS WEBSITE, YOU SHOULD READ THIS AGREEMENT CAREFULLY. BY DOWNLOADING OR UPLOADING ANY CONTENT FROM OR TO THE GAME GROWERS WEBSITE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT.
YOU MAY BE PART OF GAME GROWERS IF YOU ARE IN THE 8TH GRADE AND ARE 13 YEARS OF AGE (BY THE DATE YOU SUMBIT YOUR APPLICATION). HOWEVER, YOU MUST BE AT LEAST 18 YEARS OLD TO ENTER INTO THIS AGREEMENT. IF YOU ARE UNDER 18 YEARS OLD, YOU MUST HAVE A PARENT OR LEGAL GUARDIAN CAREFULLY READ AND GRANT PERMISSION FOR YOU TO ENTER THIS AGREEMENT.
By submitting an entry, each applicant and their parent/guardian acknowledge that they have read and hereby agree to the rules and regulations of Gamer Growers as listed here.
GAME GROWERS: This team-based, national competition provides an opportunity for 13-year-old girls to use their voice and creativity to help engage more girls in sport. Sport is defined as competition, movement, and play.
ELIGIBILITY: This program is open to legal permanent US residents who are thirteen (13) or older at the time of entry and are actively enrolled in the eighth (8th) grade. Employees of NIKE USA, Inc., its parent company, Nike, Inc., their subsidiaries and affiliates (collectively “NIKE”), or of other companies associated with the promotion of the Game Growers program, as well as the immediate family and household members of each such employee are not eligible. In addition, NIKE sponsored athletes and their immediate families are not eligible.
REQUIREMENTS FOR ENTRIES: A Game Growers Team is defined as two 8th grade girls (age 13 when the application is submitted). Teams that are accepted into Game Growers and their respective parents/guardians must be available to travel to NIKE World Headquarters, Beaverton, OR, January 24-26, 2020.
WHEN CAN I ENTER? The contest starts on or about 12:01 AM PDT on 10/17/2019 and ends at 11:59 PM EDT on 11/15/2019 (the “Entry Period”). Late or incomplete submissions will not be accepted.
HOW DO I ENTER? During the Entry Period, applicants will visit www.GameGrowers.com and follow all application instructions to complete and submit an entry. There is a limit of one (1) entry per Game Growers Team. Subsequent entries will be void. All entries become the property of Sponsor and will not be acknowledged or returned.
SELECTION OF FINALISTS: Sponsor will assign Game Growers Team submissions to a participating WNBA/NBA team that is local to each Game Growers Team as identified by the postal code identified on the Team’s application. Sponsor has the sole discretion to determine the assignment of the WNBA/NBA team. Submissions will be reviewed by Sponsor using a 100-point scale to grade and identify the top five finalists for each WNBA/NBA team. Each WNBA/NBA team will then review their top five finalists and choose their respective winning team. Submissions will be evaluated based on the following criteria (as defined below):
Innovative approach to a solution (30 points)
Creativity relative to existing resources (20 points)
Feasibility of implementation (20 points)
Potential reach and impact (20 points)
Clarity (includes visual) (10 points)
Innovative approach to a solution (30 points):
Solution uses a new or unique process, device, or idea.
Solution does not use a unique process or idea, but is innovative relative to resources or challenges in that community.
Solution does not use a unique idea or does not clearly explain how this idea is unique to the challenge.
Creativity (20 points):
Approaches the solution from a different perspective or utilizes imaginative problem-solving techniques, execution, or presentation (including leveraging existing resources).
Idea shows some imagination, but has room for improvement or is not clear how existing or new resources would be used.
Presentation or execution is not new or imaginative relative to challenge presented.
Feasibility of idea implementation (20 points)
The solution presented would work as presented, is practical to execute, or has a high likelihood of succeeding, based on information presented in the entry.
The solution might not work as presented but could work with additional support or modifications.
It is not clear how feasible the solution could be, based on the information presented in the entry, or the solution is not feasible at all.
Potential reach and impact (20 points)
The solution makes a significant positive impact relative to the challenge presented, and/or reaches a significant number of people.
The solution makes a positive impact but does not demonstrate whether this is significant.
The solution does not significantly increase existing impact, or the solution reaches a limited number of people relative to the challenge presented.
Clarity (includes visual infographic/poster) (10 points):
The solution is fully developed and well-communicated, including writing skills and/or visual presentation, organization of information, and cohesiveness.
The solution lacks some clarity and presentation skills, but the ideas are solid.
It was difficult to understand the solution as presented by the team.
Sponsor’s decisions are final, including interpretation of the rules and criteria. Participants may not make appeals or complaints against the judges, organizers, or sponsors of the Game Grower experience.
SELECTION OF FINALISTS: All finalists will be chosen and notified between December 3-15, 2019.
Finalist Teams must be available for publicity and promotional purposes after acceptance into Game Growers - including media interviews with newspapers, radio and TV. Game Grower partners may provide the media with the winning team’s details, photographs and/or video footage for publication or broadcast.
ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST/PROGRAM. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE CONTEST SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT’S ELIGIBILITY AND COMPLIANCE WITH THE OFFICIAL RULES HAVE BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS.
WHAT CAN I WIN? Each winning Game Growers Team will receive roundtrip airfare and hotel plus ground transportation for each team member and their parent/guardian to Portland to attend the Game Growers Training Camp at NIKE’s World Headquarters in Beaverton, Oregon, and the opportunity to work on the project with the WNBA/NBA team.
WHAT IS A POTENTIAL WINNER REQUIRED TO DO? Except where prohibited, a potential winner (each member of a Game Growers Team) will be required to complete and return a hard copy of the LICENSE, WAIVER AND LIABILITY RELEASE that was included in the application packet signed by parents/guardians to the address on the notification within five (5) days of being notified. The potential winner’s travel guest(s) may also be required to sign a LICENSE, WAIVER AND LIABILITY RELEASE.
INTELLECTUAL PROPERTY RIGHTS: All Submitters release ownership of all intellectual and industrial property rights (including moral rights) in their Submissions. NIKE, sponsors, agencies, and partners have full and unlimited rights to use and share submissions."Submission" means an entry consisting of the original concept material submitted for Game Growers by the Submitter. "Intellectual Property" means copyrights, design rights, patents, designs, registered designs, trademarks, service marks (or an application for any of these), inventions (whether patentable or not), invention disclosures, discoveries, improvements, processes, test and qualification processes, schematics, specifications, formulae, procedures, proprietary information, know-how, technology, trade secrets, technical data, works of authorship (whether copyrightable or not), mask works, software (in source code and object code forms), databases, data collections, and documentation and all copies and tangible embodiments of any of the foregoing throughout the world in whatever form or medium.
Representations and Warranties: Submitter represents and warrants that the Submission including all content and material used in the Submission is the original work of the Submitter.Sponsor has the sole discretion to determine whether an entry is eligible. Any entry that violates this section or is otherwise objectionable (as determined solely by Sponsor), will not be considered and will be disqualified.
Representations and Warranties Regarding Third Party Intellectual Property: The Submitter represents and warrants to Sponsors and Organizer that Submitter has not submitted any Submission that infringes any third party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, patent, trade secret, rights of privacy or publicity, or confidentiality obligations of another.
Other Representations and Warranties: Submitter represents and warrants that:
The Submission does not violate applicable federal, state, or local laws; and
The Submission has not been entered in previous contests or won previous awards; and
The Submission has not been published or distributed previously in any media; and
The Submission does not contain any claims that are not and cannot be substantiated or that would be false and/or misleading.
RELEASE: To the maximum extent permitted by the law, the Submitter hereby releases, waives and forever discharges sponsors and organizer and any of their respective affiliates, officers, employees, members or agents of and from any and all claims, obligations, debts, causes of action, and liabilities whatsoever.
CONSENT: Accepting the invitation to be Game Growers, participants grant permission to sponsors and their agencies to use winners' names and/or likenesses for advertising and/or trade purposes without further compensation unless prohibited by law.
The Submitter hereby consents to use of the Submitter's name, images, photo, city, state, likeness, Submission and prize information worldwide, in perpetuity, for all purposes (including advertising, marketing, promotion, in any media outlet including wireless/mobile devices and the exploitation of any and all ancillary and subsidiary rights) and the same may be edited, in all media now known or hereafter created, throughout the world, without limitation and without payment or consideration, except where otherwise required by law. The Submitter additionally consents to the release of all Personal Data collected by the Organizer and the Organizer's agents, to the Sponsors.
INDEMNITY: To the maximum extent permitted by law, the Submitter agrees to defend, indemnify and hold harmless the Sponsors and the Organizer, and their affiliates and their respective directors, officers, employees and agents from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys' fees) arising out of or accruing from (a) any act, default or omission on the part of the Submitter; (b) Submitter's breach of any warranty set forth herein; (c) any material uploaded or otherwise provided by the Submitter that infringes any copyright, trademark, trade secret, trade dress, patent or other intellectual property right of any person or defames any person or violates their rights of publicity or privacy, (d) any misrepresentation made by the Submitter in connection with Game Growers; (e) any non-compliance by the Submitter with the Rules applicable to Game Growers; and (f) claims brought by persons or entities other than the parties to this Agreement arising from or related to the Submitter's involvement with Game Growers or use or acceptance of any prize or prize-related activity including any responsibility for travel or accommodation associated with Game Growers.
DEFINITION OF NBA ENTITIES: NBA Properties, Inc., the National Basketball Association (the "NBA"), and the NBA member teams (collectively, the "NBA Entities").
EXCLUSION OF EMPLOYEES OF THE NBA ENTITIES FROM ELIGIBILITY: Employees of the NBA Entities, including affiliates, agents and immediate family members and/or those living in the same household of such employees, are not eligible to enter or win the promotion.
LIMITATION OF LIABILITY: The NBA Entities and each of their respective parent companies, subsidiaries, affiliates, officers, directors, employees, governors, owners, distributors, retailers, agents, assignees, advertising/promotion agencies, representatives, and agents shall have no liability and will be released and held harmless from any claim, action, liability, loss, injury or damage, including, without limitation, personal injury or death to winner or any third party or damage to personal or real property due in whole or in part, directly or indirectly, by any reason, including the acceptance, possession, use or misuse of the prize and/or participation in this promotion.
RIGHT OF PUBLICITY RELEASE: Participants in this promotion (if minor, his/her parent or legal guardian) agree to be bound by these Official Rules and agree that the NBA Entities and their designees and assigns may use the participant's name, voice, city/state of residence, photos, video or film clips, and/or other visual likeness for advertising and/or trade purposes and/or for any other purpose in any media or format now or hereafter known without further compensation (financial or otherwise), permission or notification.
LIMITATION OF LIABILITY: NIKE, the sponsors and organizers accept no liability for any claims arising in connection with Game Growers. In no event shall the Game Growers’ sponsor or the organizer be liable for any loss of data, lost profits, business interruption, or other special, incidental, consequential, punitive, indirect, or speculative damages under any legal theory (including negligence and strict liability).
CHANGES: Game Grower organizers may, at its discretion, make changes to participation rules and this agreement, including but not limited to dates and deadlines, websites and resources, and recognition of submissions. Participants will be notified by email of changes.
How will disputes be handled? All disputes arising out of or connected with the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Oregon. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Oregon, without giving effect to any choice of law or conflict of law rules (whether of the State of Oregon or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Oregon.
